Terms of Service

Please read these Terms of Service (“Terms”) carefully before using absqueue.com (the “Platform”), operated by AbsQueue (“AbsQueue”, “we”, “us”, or “our”).

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement under Singapore's Electronic Transactions Act 2010. Your continued use of the Platform following any changes to these Terms constitutes acceptance of those changes.

1. About AbsQueue

AbsQueue is an online marketplace that connects customers with independent, freelance, and home-based beauty service professionals (“Professionals”) in Singapore. AbsQueue provides the Platform as a venue for discovery and connection only.

AbsQueue does not itself provide beauty services. We do not employ, contract, supervise, or direct Professionals. Any service agreement is strictly between the Customer and the Professional. AbsQueue is not a party to any such agreement.

Currently, the Platform facilitates contact between Customers and Professionals via external channels (WhatsApp, Instagram, phone). We do not process payments and do not intermediate transactions.

2. Eligibility

To use AbsQueue, you must:

• Be at least 18 years of age;
• Have the legal capacity to enter into binding contracts under Singapore law;
• Not have previously been suspended or banned from the Platform; and
• Provide accurate, complete, and current information when creating your account.

Additional eligibility for Professionals: By listing on AbsQueue, you represent and warrant that you have the legal right to work and provide services in Singapore, and that you hold any licences, permits, or approvals required by law for the services you offer (including, where applicable, approval from the Housing & Development Board (HDB) or the Urban Redevelopment Authority (URA) to operate a home-based business).

We reserve the right to verify eligibility and to refuse or terminate access to any user who does not meet these requirements.

3. Account Registration and Security

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, truthful, and complete information during registration and keep it current;
• Maintain the confidentiality of your password and login credentials;
• Notify us immediately at [email protected] if you suspect unauthorised access to your account;
• Accept responsibility for all activity that occurs under your account; and
• Register only one account per person.

We reserve the right to suspend or terminate accounts at our discretion, including for breach of these Terms.

4. Professional Listings and Obligations

Professionals who list services on AbsQueue agree to the following:

4.1 Accuracy of Listings

All profile information, service descriptions, portfolio images, and pricing must be accurate, complete, and not misleading. Professionals must update their listings promptly if any information changes.

4.2 Independent Contractor Status

Professionals are independent contractors, not employees, agents, partners, or representatives of AbsQueue. AbsQueue has no obligation to provide Professionals with work, referrals, or revenue. Professionals are solely responsible for:

• Their own tax obligations, including filing income tax returns with the Inland Revenue Authority of Singapore (IRAS) and, if applicable, registering for and collecting GST;
• Their own CPF contributions (if applicable for self-employed persons);
• Compliance with all applicable laws, licences, and permits;
• Obtaining and maintaining any required insurance (e.g., public liability insurance); and
• The quality, safety, and outcome of all services they provide to Customers.

4.3 Home-Based Business Compliance

Professionals operating from residential premises in Singapore are solely responsible for ensuring their business activity complies with HDB and/or URA home-based business rules. AbsQueue does not verify, warrant, or accept liability for Professional compliance with these rules.

4.4 Licence and Regulatory Compliance

Certain beauty services in Singapore may require licences or certifications (for example, services regulated under the Environmental Public Health Act or other health legislation). Professionals are solely responsible for identifying and complying with all applicable regulatory requirements for the services they offer.

5. User Content

5.1 Your Content

You retain ownership of content you submit to AbsQueue (such as profile photos, portfolio images, and profile text) (“User Content”). By submitting User Content, you grant AbsQueue a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform.

5.2 Your Representations

By submitting User Content, you represent and warrant that:

• You own or have the necessary rights to submit the content and to grant the above licence;
• The content does not infringe the intellectual property, privacy, or other rights of any third party; and
• The content is accurate and not misleading.

5.3 Our Rights Over Content

We reserve the right to remove, edit, or refuse to publish any User Content that we determine, in our sole discretion, violates these Terms, is misleading, is unlawful, or is otherwise objectionable, without prior notice.

6. Prohibited Conduct

You must not use the Platform to:

• Violate any applicable Singapore law or regulation, including the Computer Misuse Act, PDPA, or Consumer Protection (Fair Trading) Act 2003;
• Post false, misleading, or fraudulent listings, reviews, or profile information;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Harass, intimidate, threaten, or abuse other users;
• Use automated tools (bots, scrapers, crawlers) to access, extract, or copy content from the Platform without our written permission;
• Introduce malware, viruses, or other harmful code;
• Solicit personal data from other users beyond what is necessary for legitimate service enquiries;
• Attempt to circumvent any Platform security measures; or
• Use the Platform for any unlawful, harmful, or commercially exploitative purpose.

Violation of these prohibitions may result in immediate suspension or termination of your account and, where appropriate, referral to law enforcement authorities.

7. External Contact and Off-Platform Transactions

The Platform provides contact buttons that link to external channels including WhatsApp, Instagram, and phone calls. Once you leave absqueue.com:

• All communications occur on third-party platforms subject to their own terms and privacy policies;
• AbsQueue is not a party to, and bears no liability for, any agreement, transaction, dispute, or outcome arising from off-platform communications; and
• AbsQueue is not responsible for the content, privacy practices, or conduct of third-party platforms or their users.

Customers and Professionals transact directly and at their own risk. We strongly encourage both parties to exercise due diligence before engaging.

8. AbsQueue as Marketplace Intermediary

AbsQueue operates as a technology platform and marketplace intermediary only. Specifically:

• We do not verify qualifications. We do not independently verify Professional qualifications, certifications, licences, or the accuracy of profile information. Customers should perform their own due diligence.
• We do not guarantee service quality. AbsQueue makes no representations or warranties regarding the quality, safety, legality, or suitability of any service listed on the Platform.
• We are not an employment agency. AbsQueue does not introduce Professionals to Customers for the purpose of employment. Professionals are self-employed individuals.
• We do not process payments. All financial arrangements are negotiated and settled directly between Customers and Professionals. AbsQueue takes no commission on transactions.

9. Intellectual Property

All content on the Platform that is not User Content, including the AbsQueue name, logo, design, software, text, and graphics, is owned by or licensed to AbsQueue and is protected by Singapore and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our express written consent.

10. Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with Singapore's Personal Data Protection Act 2012 (PDPA). By using the Platform, you consent to our data practices as described in the Privacy Policy.

10.1 Optional Third-Party Integrations

Professionals may optionally connect a Google Calendar account to sync confirmed bookings. This integration is off by default and can be turned on or off at any time from your dashboard settings. Connecting Google Calendar authorises AbsQueue to create and delete calendar events on your behalf for confirmed and cancelled bookings only. See our Privacy Policy for details on what this involves and how the data is handled.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or free of viruses;
• Information on the Platform (including Professional listings and pricing) is accurate, complete, or current; or
• Results obtained from using the Platform will meet your requirements.

This disclaimer is subject to the requirements of the Singapore Unfair Contract Terms Act and does not exclude liability that cannot lawfully be excluded.

12. Limitation of Liability

To the fullest extent permitted by Singapore law, AbsQueue shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, including but not limited to loss of profits, loss of data, personal injury, or property damage, arising out of or in connection with:

• Your use of, or inability to use, the Platform;
• Any service provided (or not provided) by a Professional to a Customer;
• Any off-platform communications or transactions; or
• Any unauthorised access to or alteration of your data.

In any event, AbsQueue's total aggregate liability to you for any and all claims arising from your use of the Platform shall not exceed SGD 100.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Singapore law.

13. Indemnification

You agree to indemnify, defend, and hold harmless AbsQueue and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Platform in violation of these Terms;
• Any User Content you submit;
• Any service you provide to a Customer as a Professional (including claims by Customers regarding service quality, safety, or outcomes); or
• Your violation of any applicable law or third-party rights.

14. Termination

14.1 By You

You may terminate your account at any time by deleting it through your account settings or by emailing us at [email protected].

14.2 By Us

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including if we reasonably believe you have breached these Terms, engaged in fraudulent or harmful conduct, or if we cease operating the Platform.

14.3 Survival

The following sections survive termination of your account or these Terms: Section 5 (User Content licence, to the extent needed to keep existing content on the Platform), Section 8 (Marketplace Intermediary), Section 9 (Intellectual Property), Section 11 (Disclaimer of Warranties), Section 12 (Limitation of Liability), Section 13 (Indemnification), and Section 15 (Governing Law and Disputes).

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

15.2 Dispute Resolution

We encourage users to resolve disputes directly. If you have a complaint about the Platform or another user, please contact us first at [email protected].

For disputes between Customers and Professionals, we recommend contacting the Consumers Association of Singapore (CASE) or using the Singapore Mediation Centre (SMC) for mediation before commencing legal proceedings.

15.3 Jurisdiction

Subject to the dispute resolution process above, you and AbsQueue submit to the exclusive jurisdiction of the courts of the Republic of Singapore for the resolution of any dispute arising under or in connection with these Terms.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and AbsQueue regarding your use of the Platform and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the “Last Updated” date at the top of this page;
• Notify registered users by email at least 14 days before the change takes effect where reasonably practicable.

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform.
